Regency Hospital Limited and its subsidiaries (hereinafter referred to as “RHL”) are committed to respecting the privacy and choices of every person who shares information or data with RHL. Your privacy protection is important to us and we strive to take due care and protection of the information we receive from you (“the Users”). In this regard, we adhere to the various governing laws such as:

• The Information Technology Act, 2000 – Section 43A.
• The Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Information) Rules, 2011.

This Privacy Policy applies to the collection, storage, processing, disclosure and transfer of your Personal Information (defined below) as per the above mentioned laws, including when you use the website of https://regencyhealthcare.in and/or App operated by RHL for any information or services or through offline documentation by which you provide us with your Personal Information for any information or services.

RHL does not share Personal Information about Users except (a) to provide services, Users have requested; (b) when RHL has Users’ permission; or (c) under the following circumstances:

• We provide the information to trusted entities who work on behalf of or with RHL under strict confidentiality agreements. These entities may use the Personal Information to help RHL communicate with Users about our services and offers. However, these companies do not have any independent right to further share or disseminate this information.
• We believe it is necessary to share the information in order to investigate, prevent, or take action against any illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, or as otherwise required by law.
• We believe it is necessary to share the information in order to protect or enforce RHL’s rights, usage terms, intellectual or physical property or for the safety of RHL or associated parties.
• We may share information about you if RHL is acquired by or merged with another company.

Users may choose to give us Personal Information to provide you with the required information or support. We intend to protect the quality and integrity of your personally identifiable information. RHL will not be liable for any unsolicited information provided by Users.

Your Personal Information may be used or processed for providing effective services, improving the Website, App, performing studies, research and analysis, contacting Users via phone, SMS, WhatsApp or email for appointments, technical issues, payment reminders, deals, offers and other announcements.

Personal Information

The information collected from you by RHL may constitute ‘personal information’ or ‘sensitive personal data or information. The “Personal Information” of a person to mean personal information about that person relating to:

• passwords;
• financial information such as bank accounts, credit and debit card details or other payment instrument details;
• physical, physiological and mental health condition;
• sexual orientation;
• medical records and history;
• biometric information;
• information received by body corporate under lawful contract or otherwise;
• visitor details as provided at the time of registration or thereafter; and
• call data records

Information that is freely available in the public domain accessible under the Right to Information Act, 2005 or any other law will not be regarded as Personal Information.

In addition to addition to the above, the following information is also captured by the application for supporting the patient needs:

• SSID/BSSID : This is used for checking the status & strength of Wifi Signals and determining the best possible way for rendering the information.
• Bluetooth : This is used for relaying the audio of voice and video calls to Bluetooth enabled speakers
• Camera : This is used to allow capture of patient records, displaying patient information during a video call
• Images, Files : These are used for accessing the images/docs so that patient can upload the doc or images and share them with the doctor
• Audio : This is required for accessing mic for using the video call and for cases where patient may want to speak instead of typing
• GPS location : Location is required for fetching address (for availability of services) & nearby hospital

Collection of Personal Information

Your Personal Information is collected in a variety of methods, including but not limited to:

• When you fill the patient registration form,
• When you provide details to a RHL doctors’/ representative,
• When you register on our Website/App,
• When you provide your Personal Information to us during course of receiving services

Consent

You acknowledge that by using the Website/App, you have voluntarily provided your Personal Information and understand how it will be utilized, you also consent to the collection, storage, processing, disclosure, and transfer of any Personal Information in accordance with the provisions of this Privacy Policy. However, we shall not be liable for any loss that may happen to you due to the provision of inaccurate Personal Information by you. Your information which is available online shall be used in accordance with the terms of this privacy policy, while offline information will be managed as per the prescribed norms and rules of the Company.

RHL reserves the right to use information provided by or about the End-User for the following purposes:

• Publishing such information on the Mobile apps/ Website.
• Contacting End-Users for offering new products or services.
• Contacting End-Users for taking product and Service feedback.
• Analyzing software usage patterns for improving product design and utility.
• Analyzing anonymized practice information for commercial use.

RHL does not control or endorse the content, messages or information found in any Services and, therefore, RHL specifically disclaims any liability with regard to the Services and any actions resulting from your participation in any Services, and you agree that you waive any claims against RHL relating to same, and to the extent such waiver may be ineffective, you agree to release any claims against RHL relating to the same.

You are responsible for maintaining the accuracy of the information you submit to us, such as your contact information provided as part of account registration. If your personal information changes, you may correct, delete inaccuracies, or amend information by making the change on our member information page or by contacting us.

You have the right refuse to provide the information sought by RHL, and the right to withdraw your consent at any time. To do so, please notify us in advance by sending an email to coordinator@regencyhealthcare.in. Please note that your withdrawal of consent to use your Personal Information may result in RHL not being able to provide you with access to the Website/App or terminate any existing relationship that RHL may have with you.

Cookies

The Website uses temporary cookies to store certain non sensitive personal data or information that is used by RHL and its service providers for the technical administration of the Mobile apps/ Website, research and development, and for User administration. In the course of serving advertisements or optimizing services to its Users, RHL may allow authorized third parties to place or recognize a unique cookie on the User’s browser. The cookies however, do not store any Personal Information of the User. You may adjust your internet browser to disable cookies. If cookies are disabled you may still use the Mobile apps/ Website, but the Mobile apps/ Website may be limited in the use of some of the features.

This Privacy Policy applies to Services that are owned and operated by RHL. RHL does not exercise control over the sites displayed as search results or links from within its Services. These other sites may place their own cookies or other files on the Users’ computer, collect data or solicit personal information from the Users, for which RHL is not responsible or liable. Accordingly, RHL does not make any representations concerning the privacy practices or policies of such third parties or terms of use of such Mobile apps/ Website, nor does RHL guarantee the accuracy, integrity, or quality of the information, data, text, software, sound, photographs, graphics, videos, messages or other materials available on such Mobile apps/ Websites. The inclusion or exclusion does not imply any endorsement by RHL of the Mobile apps/ Website, the Mobile apps/ Website’s provider, or the information on the Mobile apps/ Website. If you decide to visit a third-party website linked to the Mobile apps/ Website, you do this entirely at your own risk. RHL encourages the User to read the privacy policies of that Mobile apps/ Website.

Reasonable Security Practices and Security of Personal Information

We are committed to protecting your privacy. It is important to us that our customers retain their privacy while taking advantage of the services that we have to offer. To this end, we adhere to the following basic principles:

We employ the highest levels of security to keep your Personal Information strictly confidential.

We will not disclose or sell any of your Personal Information, including your name, address, age, sex or medical history or other personal information mentioned above to any third party without your permission. The Mobile apps/ Website may enable User to communicate with other Users or to post information to be accessed by others, whereupon other Users may collect such data. Such Users, including any moderators or administrators, are not authorized RHL representatives or agents, and their opinions or statements do not necessarily reflect those of RHL, and they are not authorized to bind RHL to any contract. RHL hereby expressly disclaims any liability for any reliance or misuse of such information that is made available by Users or visitors in such a manner.

We adopt adequate measures to prevent unauthorized access to your Personal Information and have implemented reasonable security practices commensurate to the standards required under applicable laws and industry best practices.

The security of your Personal Information is important to us. We have adopted reasonable security practices and procedures including role-based access and need to know basis, password protection, encryption etc. to ensure that the Personal Information collected is secure. We restrict access to your Personal Information to our and our affiliates’ employees, agents, third party service providers, partners, and agencies on a need to know basis and in relation to the purposes as specified above in this Policy.

We endeavor to take all reasonable and appropriate steps to keep secure any information which we hold about you and prevent unauthorized access.

The data collected and stored offline is secured by keeping it in a safe place/room with appropriate security. The Company takes necessary measures to protect the data from any kind of fraud and to comply with all applicable laws at all times. Staff shall be provided access to Personal Information only to the extent necessary to serve the applicable business purpose of RHL and to perform their job. Staff who access Personal Information shall meet their confidentiality obligations.

Though we try to protect Personal Information and prevent any unauthorized access, no system is 100% foolproof and RHL will not be liable for unintended breach of data causing disclosure of Personal Information.

No administrator at RHL will have knowledge of your password. It is important for you to protect against unauthorized access to your password, your computer and your mobile phone. Be sure to log off from the Mobile apps/ Website when finished. RHL does not undertake any liability for any unauthorized use of your account and password. If you suspect any unauthorized use of your account, you must immediately notify RHL.

Term of Storage of Personal Information

We will retain your information for as long as necessary to provide you with the services. We shall not retain such information for longer than is required for the purposes for which the information may lawfully be used or is otherwise required under any other law for the time being in force.

RHL may keep records of electronic communications and telephone calls received and made for making appointments or other purposes for the purpose of administration of Services, customer support, research and development and for better listing of Practitioners.

To the extent necessary to provide End-Users with the Services, RHL may provide their Personal Information to third party contractors who work on behalf of or with RHL to provide End-Users with such Services, to help RHL communicate with End-Users or to maintain the Mobile apps/ Website. Generally, these contractors do not have any independent right to share this information, however certain contractors who provide services on the Mobile apps/ Website, including the providers of online communications services, may use and disclose the personal information collected in connection with the provision of these Services in accordance with their own privacy policies. In such circumstances, you consent to us disclosing your Personal Information to contractors, solely for the intended purposes only.

Grievance Officer

We have appointed a Grievance Officer to address any concerns or grievances that you may have regarding the processing of your Personal Information. If you have any such grievances, please write to our Grievance Officer at coordinator@regencyhealthcare.in and our officer will attempt to resolve your issues in a timely manner.

Amendments & Modifications

Any or all provisions of this Privacy Policy would be subject to revision/ amendment by Human Resource Department based on the recommendations of IT Department or in accordance with the applicable laws on the subject as may be specified from time to time.

Children’s and Minor’s Privacy

RHL strongly encourages parents and guardians to supervise the online activities of their minor children and consider using parental control tools available from online services and software manufacturers to help provide a child-friendly online environment. These tools also can prevent minors from disclosing their name, address, and other personally identifiable information online without parental permission. Although if intended for use by minors, RHL respects the privacy of minors who may inadvertently use the internet or the mobile application.

Jurisdiction

Any dispute shall be subject to exclusive jurisdiction of Courts in Kanpur, Uttar Pradesh.
