INTRODUCTION

Regency Hospital Limited (“RHL”, “we”, “our”, or “us”) is committed to protecting the privacy and personal information of doctors using the Regency MyCare Doctor App (“Doctor App” or “App”).

The Doctor App is a digital healthcare platform designed to facilitate appointment management, teleconsultations, access to patient records, prescription management, and other healthcare-related services for authorized medical practitioners associated with Regency Hospital Limited.

In the course of providing these services, Regency Hospital Limited may collect, use, store, share, retain, and otherwise process personal information relating to registered doctors and, where necessary for the provision of healthcare services, facilitate authorized access to patient-related information through the App.

This Doctor App Terms & Conditions and Privacy Policy describe how personal information is collected, used, disclosed, retained, and protected in connection with the Doctor App. It also outlines the responsibilities of doctors using the platform and the measures adopted by Regency Hospital Limited to protect personal information in accordance with applicable laws and regulatory requirements.

By registering for, accessing, or using the Doctor App, you acknowledge that you have read, understood, and agreed to the Terms & Conditions and Privacy Policy set out herein.

Regulatory Frameworks

Digital Personal Data Protection Act

The Digital Personal Data Protection Act, 2023 (DPDP Act) governs the processing of digital personal data in India and establishes obligations for Data Fiduciaries, rights for Data Principals, and enforcement powers for the Data Protection Board of India.

Regency Hospital Limited recognizes the importance of protecting personal information processed through the Regency MyCare Doctor App and is committed to handling such information in a lawful, fair, transparent, and secure manner.

It is the policy of Regency Hospital Limited to implement appropriate technical and organizational measures to safeguard personal information and to ensure that the collection, use, storage, sharing, retention, and disposal of personal data through the Doctor App are carried out in accordance with the DPDP Act, applicable healthcare regulations, telemedicine guidelines, and other relevant legal and regulatory requirements.

Definitions

For the purposes of this Terms & Conditions and Privacy Policy, the following terms shall have the meanings assigned below:

App

“App” means the Regency MyCare Doctor App, including its associated services, features, portals, and functionalities made available by Regency Hospital Limited.

Data Fiduciary

“Data Fiduciary” means any person who alone or in conjunction with other persons determines the purpose and means of processing of personal data. For the purposes of this Policy, Regency Hospital Limited shall act as a Data Fiduciary in relation to personal data processed through the App.

Data Principal

“Data Principal” means the individual to whom the personal data relates and includes a parent or lawful guardian of a child or a person with disability, where applicable.

Personal Data

“Personal Data” means any data about an individual who is identifiable by or in relation to such data.

Processing

“Processing” means a wholly or partly automated operation or set of operations performed on digital personal data, including collection, recording, organization, storage, adaptation, retrieval, use, disclosure, sharing, transmission, restriction, erasure, or destruction.

Patient

“Patient” means any individual who receives, seeks to receive, or is registered for healthcare services through Regency Hospital Limited.

Regency Hospital Limited (RHL)

“RHL”, “we”, “our”, or “us” means Regency Hospital Limited and its authorized affiliates involved in operating and supporting the App.

Collection and Use of Personal Information

Regency Hospital Limited and its subsidiaries (“RHL”) collect and process personal information about registered doctors using this application. The following information may be collected:

  • Identity and Registration Details: Name, medical registration number, qualifications, specialization, and contact information provided at the time of registration.
  • Consultation Data: Information exchanged during virtual consultations, including prescriptions issued, clinical notes, and patient interaction records.
  • Device Permissions Accessed by the App: Camera (for video consultations and capturing documents); Microphone (for audio during video calls); GPS Location (for verifying service availability); Files and Images (for sharing and receiving patient documents); Bluetooth (for routing audio to connected devices).
  • Usage Data: App usage patterns and technical diagnostics used to improve the application’s performance and design.

This information is used to provide and operate the consultation platform, communicate with doctors regarding appointments and technical issues, comply with applicable regulatory and legal requirements, and improve the quality of services offered through the app. RHL does not sell personal information to third parties. Data may be shared with trusted service providers acting on RHL’s behalf under strict confidentiality obligations, or where required by law.

Under the DPDP Act, every Data Fiduciary is required to:

  • Establish an effective grievance redressal mechanism; and
  • Publish the contact details of a Grievance Officer to address grievances raised by Data Principals.

Regency Hospital Limited shall designate and publish the contact details of its Grievance Officer in accordance with statutory requirements.

Terms and Conditions for Doctors Offering Virtual Consultations:

By agreeing to provide consultation services through this platform, you confirm the following:

  • Medical Registration: You are a registered medical practitioner listed in either the Indian Medical Register or a State Medical Register, as per the Indian Medical Council Act, 1956.
  • Compliance with Rules: You will adhere to all applicable rules, regulations, and guidelines concerning virtual consultation services, both current and future.
  • Professional Conduct: You agree to follow the Indian Medical Council (Professional Conduct, Etiquette, and Ethics) Regulations, 2002.
  • Display of Registration Number: You will prominently display your registration number issued by the Medical Council of India and/or State Medical Council on all relevant documents, such as prescriptions, websites, and electronic communications related to virtual consultations
  • Patient Introduction: You will begin each consultation by introducing yourself, stating your name and medical qualifications.
  • Verification of Age: At the start of the consultation, you will verify the patient’s age, and if necessary, request proof of age. For minors, you will only proceed with the virtual consultation if an adult guardian is present, whose identity must also be confirmed.
  • Respect for Patient Preferences: You will respect the patient’s choice and will not insist on a virtual consultation if they prefer an in-person visit or explicitly request one.
  • Clinical Judgement: If you feel that a diagnosis or prescription cannot be accurately provided through virtual consultation, you will indicate this on the prescription and recommend that the patient seek in-person care at an appropriate medical facility.
  • Emergency Situations: In emergency cases, you will advise the patient to seek immediate in-person care from a registered medical practitioner.
  • Prescribing Medications: You will ensure all prescriptions comply with the applicable guidelines and do not violate the Drugs and Cosmetic Act, 1940. You will not prescribe medications listed in the Prohibited List of the Telemedicine Guidelines.
  • Confidentiality: You will ensure that patient records, data, and images are kept confidential and are not misused in any way.
  • Professional Standards: You will uphold the same professional and ethical standards in virtual consultations as in traditional in-person care. Despite the limitations of telemedicine, you will make every effort to gather sufficient medical information before exercising clinical judgment.
  • Legal Jurisdiction: Any disputes arising from these services will fall under the exclusive jurisdiction of the courts located in Kanpur, UP.

Term of Storage of Personal Information

Regency Hospital Limited (“RHL”) shall retain personal information collected through the Doctor App only for as long as is necessary to fulfil the purposes for which such information was collected and processed, including the provision of healthcare services, teleconsultation services, appointment management, regulatory compliance, audit requirements, dispute resolution, and other legitimate operational purposes.

Personal information shall not be retained for a period longer than is required for the specified purpose, unless retention is necessary to comply with applicable laws, regulatory requirements, healthcare record retention obligations, court orders, contractual commitments, or other lawful purposes.

Upon expiry of the applicable retention period or where the purpose for processing no longer exists, personal information shall be deleted, anonymized, or otherwise disposed of in accordance with applicable legal, regulatory, and organizational requirements.

Security of Personal Information

Regency Hospital Limited (“RHL”) is committed to protecting the confidentiality, integrity, and availability of personal information processed through the Doctor App. RHL implements reasonable technical, organizational, and administrative safeguards designed to protect personal information against unauthorized access, disclosure, alteration, loss, destruction, misuse, or other unauthorized processing.

Such safeguards may include user authentication mechanisms, role-based access controls, secure communication channels, encryption, logging and monitoring of system activities, backup and recovery procedures, vulnerability management.

RIGHTS OF THE INDIVIDUAL

The data subject has the following rights under the DPDP Act. These consist of:

  • Right to Access Information: To request information regarding the personal data being processed by Regency Hospital Limited and the purposes for which such data is being processed.
  • Right to Correction and Erasure: To request correction, completion, updating, or erasure of personal data, subject to applicable legal, regulatory, healthcare, and record-retention requirements.
  • Right to Withdraw Consent: To withdraw consent previously provided for the processing of personal data, where such processing is based on consent. Withdrawal of consent shall not affect the lawfulness of processing undertaken prior to such withdrawal.
  • Right to Grievance Redressal: To raise concerns, complaints, or grievances regarding the processing of personal data and seek resolution through the grievance redressal mechanism established by Regency Hospital Limited.
  • Right to Nominate: To nominate another individual who may exercise applicable rights on behalf of the Data Principal in the event of death or incapacity, in accordance with applicable law.

Requests relating to the exercise of these rights may be submitted through the contact details provided in this Privacy Policy and shall be addressed in accordance with applicable legal and regulatory requirements.

Each of these rights is supported by appropriate procedures within Regency Hospital Limited that allow the required action to be taken within the timescales stated in the DPDP Act. The timescales that Regency Hospital Limited follows are shown in the table below.

Data Deletion

Subject to applicable law, users may request the deletion or erasure of their personal data held by Regency Hospital Limited (“RHL”).

To submit a data deletion request, please send an email to coordinator@regencyhealthcare.in with the subject line “Data Deletion Request” and include your registered name, registration details (where applicable), and contact information to enable verification of your identity.

Upon receipt of a valid request, RHL shall review and process the request within 30 days in accordance with applicable legal, regulatory, healthcare, operational, and record-retention requirements.

Please note that certain information may continue to be retained where such retention is necessary for compliance with applicable laws, healthcare record-retention obligations, regulatory requirements, legal proceedings, audit requirements, fraud prevention, security purposes, or the establishment, exercise, or defense of legal claims.

Where deletion is approved and completed, RHL may notify the requester through the registered contact details. Deletion of account-related information may result in suspension or termination of access to the Doctor App and associated services.

Grievance Redressal

Regency Hospital Limited (“RHL”) is committed to addressing privacy-related concerns, requests, complaints, and grievances in a fair, transparent, and timely manner.

For any queries, concerns, requests relating to personal data, exercise of rights under applicable law, or grievances regarding the processing of personal information through the Doctor App, users may contact:

RHL shall make reasonable efforts to acknowledge and address grievances within the timelines prescribed under applicable laws and regulatory requirements. Where additional information is required to process a grievance or request, RHL may contact the requester for verification or clarification.

If the individual is not satisfied with the resolution provided by the Data Fiduciary, they may escalate the matter to the Data Protection Board of India in accordance with the DPDP Act.
